1. Scope of Application

1.1 These General Terms and Conditions (AGB) apply to all orders placed by customers via the website www.constansattic.com. Deviating conditions of the customer are not recognized unless we explicitly agree to their validity in writing.

1.2 A consumer within the meaning of these AGB is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

1.3 An entrepreneur within the meaning of these AGB is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

3. Offer and Conclusion of Contract

3.1 The product representations in the online shop are to be understood as an invitation to order and do not constitute a legally binding offer. By placing an order using the order form, the customer makes a binding offer.

3.2 The contract is concluded when we accept the customer’s offer by confirming the order via email or by delivering the goods.

 

4. Prices and Payment Terms

4.1 All prices stated are final prices and include the statutory value-added tax, as we are classified as a small business according to § 19 UStG and do not charge VAT.

4.2 Additional shipping costs may apply, which will be displayed to the customer during the ordering process.

4.3 The customer can choose from the following payment methods:

  • Advance Payment: Transfer of the invoice amount to our account.
  • PayPal: Payment via the payment service provider PayPal.
  • Credit Card: Payment by credit card.

5. Delivery and Shipping Conditions

5.1 Delivery is made to the address specified by the customer.

5.2 The delivery time is typically 3-5 working days, provided the goods are in stock. In case of delivery delays, we will promptly inform the customer.

5.3 Self-collection is not possible for logistical reasons.

 

6. Retention of Title

The seller retains ownership of the delivered goods until full payment of the purchase price has been received.

 

7. Liability for Defects (Warranty)

7.1 The statutory warranty rights apply.

7.2 As we mainly offer used flea market items, minor signs of use or defects may be present and are part of the character of the items. The products are offered as depicted. Claims for defects are excluded if the defect is clearly visible in the product presentation.

 

8. Liability

Liability for slight negligence is excluded unless it involves the violation of essential contractual obligations. In such cases, liability is limited to typically foreseeable damages. We are only liable for damages resulting from the use of products in the event of intent or gross negligence.

 

9. Data Protection

The processing of personal data is carried out in accordance with our privacy policy, which is available on the website. The customer consents to the collection and processing of their data within the scope of contract processing.

 

10. Applicable Law

For all legal relationships between the parties, the law of the Federal Republic of Germany applies.

 

11. Alternative Dispute Resolution

11.1 The EU Commission provides a platform for online dispute resolution, which you can find at https://ec.europa.eu/consumers/odr.

11.2 The seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

 

12. Final Provisions

Changes or additions to the contract must be made in writing. This also applies to the cancellation of this requirement for written form.
